Endlosod I beg to hand you docket report and
three copies of indictment returned January 18th, 191?,
against Louisville & Nashville Railroad Company by the
Letcher Grand Jury charging the unlawful delivery of four
barrels of beer to Nannie Louigi at Fleming Ky. on August
10th, 1916, summons on which was exscuted on I. B. Fields,
Agent, on February 23d.
You will note that the indictment charges
the delivery of four barrels of beer containing 420 pints.

. Against Indictment.
Louisville & Nashville Railroad Co. Defendant.
‘ The Grand Jury of Letcher County, in the name and
t by the authority of the Commonwealth of Kentucky, accuse the
defendant, Louisville & Nashville Railroad Co., a corporation
duly created and existing under and by virtue of the laws of
the State of Kentucky, and duly authorized to engage in, and ‘«
engaged in the business of a common carrier for hire, in
Letcher County, and elsewhere, said county being a territory
where the local option law is and was at the time in force,
of the offense of unlawfully, wilfully and knowingly deliver-
ing intoxicating, spirituous, vinous and malt liquors to
another, upon the package of which there appeared the false
statement that same was for the personal and family use of the
said consignee, when as a matter of fact, as xxxxxzx was well
known to defendant, its agents, servants and employees in
— charge of said delivery, at and before the time of said de-
livery, said whiskey was not for the personal nor family use
of the said consignee, but was for the purpose of being sold
in said county in violation of the local option law in force
in said county, committed in manner and form as follows: The
said defendant, Louisville & Nashville Railroad Co. on the 10th
day of August 1916, in the county aforesaid, did unlawfully,
wilfully and knowingly deliver to Nannie Luigi four barrels
of beer containing 420 (120?) pints of beer, and other quan-
tities of beer, upon the outside of which barrels containing
said beer nan there appeared the false statement that said
beer was for the personal and family use of the consignee,
when in truth and fact, as was well known to defendant, its
agents, servants and employees in charge of said delivery,
said beer was not for the personal nor family use of the said
consignee, but was intended to be sold by him in violation of
‘ the local option laws in force in said county, said county
being at the time a territory where the local option law was
in force, against the peace and dignity of the Commonwealth
of Kentucky.
