This suit grows out of mullins' alleged
wrongful ejection while enroute from Elkatawa, Ky.
to Jackson, Ky. in February of this year. This
train was in charge of Conductor Martin who writes
as follows:

"Mr. Bass,traveling Auditor for the

L&N was in the smoking car at that time and
asked me what was the matter with that man
and I told him that he had no money and I let
him off right where he got on."

styled case. I now hand you herewith that portion
of our office file containing Law Agent Landrum's in-
vestigation of this suit which grows out of ulaintiff's
alleged wrongful ejection while enroute from Elkatawa,
s Ky. to Jackson, Ky. in February,1917. From my. Lan-
g drum's report it will be seen that this fellow, who at
g the tins was quite drunk, got on our train without hav-
. ging any money to pay his fare, and of course the con-
:ductor refused to carry him. He left the train with
out any force having to be applied in getting him to do

1 H. Mullins Vs L & N, Breatnitt Circuit Court
Referring to the above styled case, I enclose to you herewith
investigation made by me concerning the alleged injury sustained by
him. I have seen this nan on several different occasions concern—
ing his case and have alwaysfound him drunk or drinking and have bean
unable to get anything at all out of him, He always tells me to
go and see his lawyer. I understand that he Claims to have given
the conductor a large bill and that the conducnor put him off the
train when he demanded his change. You will note that Mark Cann and
A. B. Parsons were with him before he got on the train and that he
was very drunk and that his face was already skinned.
There is absolutely nothing in the case and we should fightii
out. Assistant Traveling Auditor T. M. Bass was the only passenger
in the smoking car at the time this man was put off. He has not been
in my territory since I have had the papers but I will arrange to
catch him.

to the depot and we set down on the out ide there and after while I
got tired and he wanted to go down to the house to stay with me end
I knew that Judge enters was arouni theresomewhere and I took him
down to Julge. It was a dark night ind I couli not hold h‘m up. He
wouli fall down. It was so dark we could n_r hardly see where we were
Toing. I left him Hith Judge and went out to the house. After
the train left I do not know how long it had been gone he come back to
the house and hollered "Care to speak to me a minute, Care to Speak to
m; a minute.” I went out to him and he asked me abou; comin in
the house. I told them that they were :11 in bed in the house and
that if I mes him I woul‘ go back to Judge Ce ters. He started out
that wey ent that w.s the lest that I SLW of him. He acted like
a trunk man and whiskey coull be smelled on him. He had a pint
bottle with a little whiskey in it nd drank all 3f it.

My name is sarah Ann Centers. I live at Elkatawa, KY. On the
night that this man was put off Of the train he come to my house
or rather was brought there by Mark Cann. He was very drunk at
the time and his face was skinned up a little. He was very drunk and
my son, Judge Centers, went with him to the train. This man was
so drunk that he could not talk with any sence at all, I Know
that his face was skinned up before he got on the train. .I told his
mother about his face being skinned up andshe told me that she
bet she Knew when he did it, That leaving his homeshe held a
light Ior him to see how to cross log by and that he fell over the
10g three or four times. That is all that I know about the matter
and I di not want to be a witness in it at all.

My name is A. B. Parsons. i am Cashier at Jackson, KY.
I was at Elkatawa the night that this man claims to have been
hurt. I was at my mother in laWS and come to Jackson on the
train that this man got on at Elkatawa, train No. 5. This
man went to Agent Hall's and woke him up about eight ociock
and Hall's brother in law, Operator Gann, got up and brought
him over to my mother in laws' When the train come myseif and
Judge Centers took him to the depot and put him on the train.
Judge Centers helped him on ELe train. I went back into the
lady‘s car as I did not want to get mixed us with him. Mullins
went into the smoking car. After the train started it stopped
and this man got off. He thoff at the telegraph pole near the
sonhh end of the station piatform at Eikzaawa and as the train
pulled out I saw him walking back toward the depot on the platform.
I was then in the lady's carvgn the rear end of the train, 1 under-
stand that this man had abou 75iéeaos in money with him that night,
& When he was brought to my mother in laws by nxm Operator Cann
a he had already hurt his face. I understand that his mother said
, that he fell off of the walk as he was leading her house coming
toward the depot. He was drunk.

My name is S. J. Martin. I live st Lexington, Ky. I was conduc-
tor on train NO. 5 the night that this can get on at Elkatawa.
There was another young fellow there that helped to put him on the
train. He was so drunk and had his face scratched u, that I
immediately asked him for his fare. He sale that he did not have
any money. I teld him that he would have to get off that I could
not hall him. The train had moved about 30 feet. He immediatel .
got up and walked out. I never had to touch him in any shape or
form. Never had my hands on him only to keep him from fallingnhen
he got on the platform. When he got on the ground he commenced
cursing and swearing and calling me everything. The train pullsi an
anc nothing more was said to him and no more attentionpaio to him
I left him in 30 feet of where he got on.

My name is G. L. Sexton. I live at Lexington. I was flagman on
train No. 5 the night that this man got on at Elkatawa. some young
fellow brought this man up and helped him on the train, so helted
him up on the ladys side and he went across over into the smoker.

The fellow said to Mr. Martin "Take care of him 3am". Mr. Martin
said all right. He walked over to him and asked him for his fare
V and I understood him to say that he did not have any or fare, I dont
know whether he said money or fare. Mr. Martin reached up and pulled
the bell curl, and told him that he would have to get off. He caugn
him by the shoulder and helped him get down the steps. He did not
have to use any force in putting him off at all. 0 ly held him up
to keep him from falling. We had not passed the south end of the
platform and this man got off on the platform. I did not notice this
man's face at all. When we left this man he was standing up,

R R CO. at Elkatawa, Ky. I know Hugh Mullins. 0n the night
that he is complaining about he come to my house early and I
believe that Mart Cann come up to the d: 0t and leafed around with
him a little While and then left him and come back to the house.
After the train passed he come back to my house and woke us up

writes on March 8th as followsz~
"This man Mullins got on train 10. 5 one night in February
basely drunk. I seen his condition and I immediately asked him for his
fare. He said that he had no money I told him he would have to get off
and he got up and got off without saying a word and after he got off he
began cussing me for everything he could say his tongue to. did not
touch this man only to keeé him fro m falling. He did not fall on the
train or after he got off as far as I could see did not carry this man
fifty feet. He got on at the north end of the_Uepot and off at the
south end and on a good gravel walk. LMr Bass ‘raveling Auditor for
the L&N was in the smoking car at that time and asked me what was the
matter with that man and I told him that he had no money and i let
