‘ lot. If the jury believe from the evidence on the date and train
in question and at the station of St. Hellcnc the plaintiff or
any one also in her presence gave to the defendants agento oper—
ating said train a reasonably sufficient signal to atOD the train
and further believe that said agents can such signal or could
have seen same by the exercise of ordinary care and failed to

. stop the train they will find for the plaintiff and unless they ‘
so boliove they will find for the defendant.
2nd. Ordinary care means that degree of care ueuelly exercéscd
by ordinarily prudent persons under circumstances like or similar
to thoeo proven in this case.
5rd. If the jury find for the plaintiff they will allow her
such a sum in damagce as the jury may belivo from the evidence
will fairly and reasonably compensate her for such phisical m1f~
faring or bodily pain, if any, which the jury may believe from
the evidence she suffered and was directly caused by the failure
if any, of the defendants to stop the train not to exceed $1000.00 _
the amount claimed in the petition.
4th Nine jurors concuring may make a verdict but if a fewer
number than twelve agree those so agreeing must sign the verdict.

— This Ford girl 18 about l6 years old and lives at Slade, Ky. ,/
Her father conducts a store there. She goes to sch00l at St HelenSZ/
returning to her home each night. She does not purchase a ticket

told the passengers that he would not remain there to flag the train.
There were rive people that were run by. Jsfs. Thomas a traveling man,
Willis Curry, a schoormboy, two oil men'afihrtfifiwfihfdmfiirl. I haVe maé

only in this territory for a snort time and In! do not Know their
names. I paid Curry and Thomas $85, eaChg. After the train passed
nanout stopping Curry went with thie girl to the home of James

arr night. At this house the teacnerS' *the schOOl were boarding
and aIter the train passed the Curry boy tool the girl to the teachers
an%fiiae remained with them, yer night, but on the following morning

The Operator-Agent at St Helené went on duty on the morning

Train N0. 2 is due‘at SM Herens at 5515“a:m.'”'He“is-oniyiaIIowed to
work at that point $5 hours,wunder the Hours of Service Law, making
his time unflat»6:l§flg.m. or him to have remained over would have
called‘ftr a violation or the Hours of Service Law. Please note Mr.
Seargeant's circular of January 9th concerning this matter.
I endeavored to settle this case with Attorney C. F. Spencer
without success but on saturday of this week or rather this morning I

had a talk with the father of the girl and believe that it can
be settied through him at $100. In other words I beiieve that he
will make Spencer accept such a preposition. I made him a
tentative preposition and have wired Mr. Warren for the necessarn
authority .
I will go to Stanton Inmnxxnx Monday morning at which
time Ford told me that he had an engagement with Spencer.
If the case is net settled, I suggest that we use in
the case, Operator Chambers,(00nductor Atchisoniandengineer
