If the jury believe from the evidence that the plaintiff on
the data and train in question gave to the defendants agents op—
erating the train a reasonably sufficient signal to stop the train
and further bclicvc that Such agents saw such signal or could have
seen samc by the cxcrcisc of orfiinary care and failed to stop tho
train, thcv will find for the plaintiff and unless they 50 believe
they will find for the defendant.
2nd. If the jury find for the plaintiff they will allow him such
a sum in damages as they may beliavc from the evidence will fair~
ly and reasonably compensate him for such Ehisical suffering and
loss of time if any and for inconveniencc and expanse if any which ’
the jury may belicvo from the evidcnce was dircctly caused by the
failure if any, of the dofendant to stop the train" not to cxcccd

The defendant moves the Court to set eside the verdict in

this action and grant it a new trial for the following reasons.
1st. Because the Verdict is not supported by the evidence or by
any sufficient evidence, and is contrary to law.
2nd. Because the court erred in not psremptorily instructing the
jury to find in: a verdict for defendant at the conchzsion of
the plaintiff‘s evidence.
3rd. Because the amount of recovery is excessive, and carries
to the mind that it was rendered through passion and prejudice,
the evidence, if damages were allowable only authorized nominal -
damages.
4th Bccwisc the court erred in giving and refusing instructions
offered.
