The plaintiff, Polly Anne Lusk states that she is the
owner and in the actual possession of the following described
tract, piece, or parcel of land, situate, lying and being on ’
both sides of the North Fork of the Kentucky River a short dis-
tance above Ulvah Station, on the above-named railroad companies'
. line. That said land is more particularly bounded and described
as follows: '
BEGINNING on a beech on the north bank of the river at
the mouth of a small drain and beginning corner of Samuel Lusk
55 acre survey of date October 27th, 1818 and corner to lot of
margaret E. husk, thence with her line N 20-00 E 6.8 poles to a '
stake in center of the railroad; thence north 8.5 poles to a stake,

poles to the BEGINNING, containing 680 acres more or less.

Plaintiff says that the above described tract, piece, or
parcel of land was formerly a portion of the home farm of her father
John W. Lusk; that during the life time of her father the Lexington
& Eastern Railway Company procured from him a deed for a strip of
land 80 feet wide, lying on the north side of the Kentucky river and
running up and down said river, and where it passes through the lands
hereinbefore described, said right-of—way was located near to and on
the north bank of said river. That the Lexington & Eastern Railway
Company at the directions and suggestions of the Louisville & Nash-
ville Railraad Company, constructed its road bed on said right of

way and in so doing it throwed rock, shale, dirt and other debris
into and along thenorth bank of said river through the lands herein
before described, and after the construction.of said railroad that '
the said defendants constructed a county road on the south side of
said railroad by which it extended the fill farther into the river
bed a distance of about one-fourth of a mile from the east end of ‘
the boundary hereinbefore described down said river by which it made
the river bed at this point a great deal narrower and made the bank
along the north side of said river higher and made it a wall of rock
a) that it forced the river in times of tides and freshets against
the south bank of said river with a great deal more pressure, and
that during the year 1917 by reason of said fills being placed in
the river it has caused the water of said river to flow against, upon
and over the bank of plaintiffs lands along the south side of the .
river and has washegiggd washed away the trees and shrubbery
that was growing on the bank and which was kept by plaintiff and
permitted to grow there for the purpose of protecting said bank and
i that it has washed away plaintiff's land which is of a loose, sandy
_ nature, but was valuable for the purpose of cultivation, and has
washed away plaintiff’s fencing and will continue to wash away
plaintiff’s valuable land and fencing and timber, all of which has
damaged plaintiff in the full and just sum of $1000.00a That said
embankment is a permanent structhre, and that plaintiff is entitled ‘
' to recover the full amount of the damage that has already or will
inihe furture occur to her said land by reason of said embankment,
Which plaintiff now says is at least $1000.00. ‘
WHEREFORE, plaintiff prays judgment against the defendants
for the sum of $1000.00, for her costs herein expended and £11 preper
relief. ,
