term of the Breatbitt Circiit Court, overruled our motion for
new trial in the above-styled case, which he had under

day of the October term to file bill of exceptions. I request-

; evidence in this case premptly and Submit it, with the draft

f you in order that you might see whether the bill of exceptions

promptly and endeavor to have the evidence transcribed and

Enclosed I hand you copy of letter to me from J. Mott
McDaniel, dated Aug. 13, 1917, referring to the judgments
in these two cases, in which motions for new trials, I understand,
were overruled at the late term of the Breathitt L'ircuit Court;
also referring to the C.L.Bonta and Lora dents cases, in which
motions for new trials were overruled at the same term (our file
85743).
Vou will observe that McDaniel is asking us to settle
the judgments for #100 each in the Ance hobinson and C.L.
Bonta cases, upon the View that there is no appeal by the company
from those judgments, and that if the company attempts to appeal
them he will move to dismiss the aspeals and there will be nothing
left for the Court of Appeals to do, except dismiss them. I fear
he is right about this. Therefore, I wish you would take
- ' this up with Judge Pollard at once and have the judgments in the -
Ance Robinson and C.L.Bonta cases certified to this office for voucher.
But, of course, we will go on with the appeals in the
Edna Robinson and Lora Bonta cases, as McDaniel seems to assume we
will do. ,
I enclose copy of letter of this date to McDaniel.
Of course, we ought to pay the judgments for 9100 each
in the Ance Robinson and C.L.Bonta cases before execution issues.

At the August term of the Breathitt Girouit Court motions
for new trials were overruled in two sets or consolidated~fdr~
trial cases. One Was Anoe and Edna Robinson v L&N R Co. in which there
was a verdict for Anee for #100 and for Edna Robinson for #500.

_ The other was 0 L and Lore Bonta in which there was a
verdict and judgment for C.L.30r #100 and for Lora for 9400.

Now I am asking that these one hundred dollar judgments
be paid without execution or attempt at appeal which would be
followed by motion to dismiss appeals in the hundred dollar cases.

Will you not see that this is done without further
expense and trouble and write me whether to have execution
issue.

Dear Sir,

Your letter July 24 presents an interestin: question,
namely, as to whet will be the effect if Juoge poems should
cease to be the judge before he neesee on our motion for new
trial made at the last term of court and continued by him to
this term. You seem to feel there is quite a strong probability
that Juoge Aieme may éie at almost any time - end without
having decieed the motion for new trial.

I do not fine that this exact question has been aecieei
by the Court of Appeals of Kentucky. Although. it may have
been and I have overlooked or have been unable to find the
case. of course, we start out with the proposition well
established in Kentucky that -

"There is no judgment in feet upon the verdict of a
jury until the motion for a new trial, if mace in proper
time, is disposed of. This motion euspends the judgment,
and it has no more effect than the veriict of the jury until
the application for a new trial is overruled. Any other
construction of the law would aepriVe parties of the right
to an appeal in all cases, where the court, for prudential
reeeone or otherwise. saw nroper to continue the motion from
one term to another, a right that the court can eXerciee,
end OVer which neither the counsel nor his client have any
control."

In the absence of a decision of the Court of Appeals to the
contrary. it seems to me the legicel effect of the principle
above stated is, that where a judge dies or for other cause
ceases to be judge, before he passes on a motion for new
trial, this fact, automatically we might say, grants the
losing party a new trial, because, except by acroemcnt of
the yartiee, ee we discuesefi recently in connection with
the bill oi exceptions in the Lerrison Shite case, it is
impossible to see how a juige the did not hear the trial
eoulfl gees on the motion for new triele And, while the
parties might be willing to agree thet a judge who did not
hear the trial should approto the bill of eXCegtions, as
was done in the Harrison Lhite case, it is inconceivable
that the losing party would be willing to agree that another
judge might overrule the motion for new trial, or that the
winning party would agree that another juuge might sustain
the motion for new trial - in othei words, it is not
supposeble that the new trial could be either granted or
refuse& by agreement of the parties.

While there is no Kentucky authority that 1 have been
able to find on this pr0poeition, it hes been held in other
jurisdictions, in accordance with the view above suggested,
that in the absence of e controling statute to the contrary,

is not in point hero, as you will see upon routing it.
There are, however, some other cases cited in the notes
which you might examine.

In People ex rel. wright v. Superior Gt. Juige, 49
E.E. 925, the Supreme Court of Liohigan, in a case'xhoro
the judge oied without having approvea the bill of exceptions,
halo that the losing party was entitled to a new trial as
matter of right. It seems to no from the reason of the
thing that this must be the rule. TherefOre, I soo no
necessity for our pressing Judge Adams to pass on the motion

Yours June 2, straightening me out as to the status
of this case, received. I had not at the time I wrote
you, nor until now, seen Judge Pollard's report of
proceedings May 22 showing the steps taken in this
case down to February 1, 1917, when the hearing of
the motion and grounds for a new trial was continued until
the next term. Of course, inasmuch as the motion for new
trial has not yet been passed on, the case will not be an
appearance to the fall term, even if the motion for new
trial should be overruled between now and then. So there
will be plenty of time to tender our bill of exceptions and
have it approved and the record made for the winter term,
1918. I should like to have Judge Pollard remember to advise
me promptly, after the court passes on the motion for new
