The Board of Trustees of the University of Kentucky met in regular statutory session at 2:00 p.m. (Eastern Daylight Time) on Tuesday, September 19, 1978, in the Board Room on the 18th floor of the Patterson Office Tower on the Lexington campus with the following members answering the call of the roll: Mr. William B. Sturgill, Chairman, Professor Michael Adelstein, Mr. William R. Black, Governor A. B. Chandler, Mrs. Betty Carol Clark, Mr. Albert G. Clay, Mr. L. D. Gorman, Mr. George W. Griffin, Mrs. Sally Hermansdorfer, Dr. David A. Hull, Mr. Thomas B. Kessinger, Mr. Ziri A. Palmer, Mr. Frank Ramsey, Mr. Homer Ramsey, Mr. Eugene Tichenor, Professor Constance Wilson, and Dr. John R. Woodyard. Absent were Mr. John R. Gaines and Mr. Richard E. Cooper, who is still officially a member of the Board until Mr. William B. Terry, named by the Governor to succeed Mr. Cooper, qualifies. The University administration was represented by President Otis A. Singletary; Vice Presidents Lewis W. Cochran, Robert Zumwinkle, Stanley Wall, Peter P. Bosomworth, Raymond R. Hornback, John T. Smith, Jack C. Blanton, and Donald B. Clapp; Dr. Wimberly C. Royster, Dean of the Graduate School and Coordinator of Research; and Mr. John Darsie, Legal Counsel. Members of the various news media were in attendance. A. Meeting Omened and Oath of Office Administered The Chairman called the meeting to order at 2:10 o'clock. Following the invocation given by Mr. Black, Mr. John Darsie ad- ministered the oath of office to Professor Constance P. Wilson. the faculty representative elected to replace Professor Paul G. Sears for a three year term ending June 30, 1981. Mrs. Betty Carol Clark, Assistant Secretary. called the roll and reported a quorum present. Mr. Sturgill declared the meeting officially open for the conduct of business at 2:14 o.m. B. Minutes Acoroved On motion duly made, seconded and carried, the reading of the Minutes of the August 1S, 1978, meeting of the Executive Committee of the Board of Trustees was dispensed with and the Minutes were approved as published. C. Reoort of the Nominating Committee Mr. Homer W. Ramsey, Chairman of the Ncminating Committee which 'as composec of r. Rams_-. :4r. Palimer and ."r. serman, preserCen zne -2- following slate of officers of the Board: Mr. William B. Sturgill, Chairman, Mr. Albert G. Clay, Vice-Chairman, and Mrs. Betty Carol Clark, Secretary, and moved that the nominations be received. His motion was seconded by Mr. Frank Ramsey and, there being no nomina- tions from the floor, the slate as presented by the nominating committee was accepted by acclamation. Mr. Ramsey then placed in nomination the names of Mr. Sturgill, Mr. Clay, Mr. Griffin, Mr. Black, and Mr. Homer Ramsey as members of the Executive Committee, with Mr. Sturgill as Chairman. There being no nominations from the floor, on motion duly made, seconded and carried, the Executive Committee nominations were accepted by acclamation. D. President's Report to the Trustees (PR 1) After reviewing a few of the items in his monthly report to the Trustees, copies of which were distributed to members of the Board, President Singletary recommended that the report be accepted and filed. Without objection, it was so ordered by the Chairman. F. Recommendafions of the President (PR 2) President Singletary, after noting that the appointments and/or other staff changes recommended in Part I of PR 2 were routine -3- in nature, called attention to Part II, which recommended a waiver of Part X-C-6 of the Governing Regulations. He emphasized that the waiver should be considered an exception based on the merits of the particular case and should not be construed as setting a precedent. He then recommended that PR 2 be aDproved as a whole. Without discussion, on motion by Mr. Black, seconded by Mr. Palmer, and passed, PR 2 was approved as a whole and ordered made an official part of the Minutes of the meeting. (See PR 2 at the end of the Minutes.) G. Approval of Degree Candidates - University System (PR 4) President Singletary recommended that PR 4, which authorized the conferring of degrees on candidates completing their work in August, be approved. On motion by Mr. Frank Ramsey, seconded by Mr. Kessinger, and passed without dissent, the President was authorized to confer the appropriate degrees upon those candidates completing their work in August 1978 upon certification by the Dean of Admissions and Registrar and approval by the University Senate that all requirements for the degrees had been satisfactorily completed. (See PR 4 at the end of the Minutes.) H. Revisions in 1978-79 Budget (PR 5) President Singletary said that the proposed revisions in the 1978-79 budget were routine in nature and recommended approval of PR 5. There being no questions, on motion by Mr. Clay, seconded by Mr. Black and passed without dissent, the budget revisions recommended in PR 5 were authorized and approved. (See PR S at the end of the Minutes.) I. Naming of University Buildings (PR 6) President Singletary suggested that inasmuch as there were two Darts to PR 6 they be acted upon separately. The Chairman concurred. President Singletary recommended that approval be given to the name of Boyd E. Wheeler Building for the new multi-purpose building at the North Central u-H Center. Mr. Palmer so moved. His motion was seconded by Mr. Gorman and passed without dissent. (See Part I of PR S at the end of the Minutes.) On President Singletary's recommendation, Mr. Homer Ramsey moved that the Board of Trustees approve the name of Harold D. Strunk Learning Resource Center for the new library at Somerset Community College. His motion was seconded by Mr. Griffin and passed without dissent. (See Part T1 of PR S at the end of the Minutes.) a. v Zali snsw'._. o:e_- :n n President Singletary explained that there were four separate ccr=1'lc- ton projects recommended in PR7-three involving community colleges and one project involving five buildings on the Lexington campus. He recommended that the Board of Trustees approve for submission to the Council on Higher Education the construction of a new library/ learning resource center at Elizabethtown Community College at an estimated cost of 1.3 million dollars; a technical building at Mavsville Community College at an estimated cost of 1.1 million dollars; an auditorium/academic facility at Somerset Community College at an estimated cost of 1.2 million dollars; and the removal of structural barriers in five buildings on the Lexington campus which impede access by physically handicapped persons at an estimated cost of $450,000. On motion by Mr. Kessinger, seconded by Mr. Gorman and passed without dissent, PR 7 was approved as a whole. (See PR 7 at the end of the Minutes.) K. Proposed Amendments to the Governing Regulations (PR 8) Noting that the proposed amendments to the Governing Regulations would bring certain of them into conformance with present practices, President Singletary recommended that the proposed amendments be received and tabled for action at the next regularly scheduled meeting of the Board. Mr. Black so moved. His motion was seconded by Mr. Homer Ramsey, and passed without dissent. (See PR 8 at the end of the Minutes.) L. Directions Regarding KRS 164.475 (PR 9) Stating that he hoped the action recommended in PR 9 would not be considered as an act of rebellion'on the part of the University but rather would be interpreted as an indication that the professional schools should be permitted to perform the roles they are supposed to perform, President Singletary recommended that the Board direct the University administration to refrain from any attempt to implement, enforce or apply the provisions of Section 164.475 of the Kentucky Revised Statutes in its present form, unless and until ordered to do so by a court of competent jurisdiction after all rights of appeal are exhausted. At the President's request, Dr. Bosomworth explained that the College of Medicine was aware of the needs of medically under- served areas in the state and that the admission process has given priority to the geographic location of applicants as one of the criteria for acceptance. Last year more applicants were accepted from rural areas than from urban areas in spite of the fact that there were more applicants from the latter. He continued that the University is working closely with the Legislative Research Commission, as well as with state and community groups such as the Municipal League and the Department of Human Resources to help recruit health service personnel for underserved areas. Acceptance of Audit Reports for 1977-78 (FCR 1) Mr. Clay, Chairman, indicated that the Finance Committee had met and reviewed the audit reports submitted by Coopers and Lybrand. He then moved that the Board of Trustees accept the University of Kentucky Purchasing Compliance Letter, the University of Kentucky Cash Reconciliation and the summarvaudit report of the financial records of the University of Kentucky for the fiscal year 1977-78 consisting of the Accountants Report from Coopers and Lybrand, Balance Sheet, Statement of Current Funds Revenues, Expenditures and Transfers, Statement of Changes in Fund Balances, Summary of Significant Accounting Policies, and Notes to the Financial Statements. His motion was seconded by Mr. Griffin and passed without dissent. (See FCR 1 at the end of the Minutes.) N. Authorization to Install a Microwave Dish on Top of Kirwan Tower (FCR 3) Mr. Clay noted that the Finance Committee had decided to withdraw FCR 2 from the agenda. After considering the request from the State Department of Mines and Minerals to install a microwave dish on top of Kirwan Tower, the Finance Committee had given its approval. Mr. Clay moved that authorization be given to the State Department of Mines and Minerals to install a microwave dish on top of Kirwan Tower. His motion was seconded by Mr. Gorman and passed without dissent. (See FCR 3 at the end of the Minutes.) 0. Report on Investments (ICR 1) Mr. Griffin, Chairman of the Investment Committee, moved that the report of changes made in investments for the University of Kentucky and its Affiliated Corporations for the quarter ended June 30, 1978, be accepted. His motion was seconded by Mr. Clay and, without dissent, it was so ordered. (See ICR 1 at the end of the Minutes.) P. Recommended Modifications to the Code of Student Conduct (SCRCR 1) Mr. Griffin, Chairman of the Board's Student Code Committee, reported that the committee had received and considered the recommended modifications forwarded to the committee by President Singletary and determined them to be desirable. He then moved that the Board of Trustees approve (1) the recommended addition to the Foreword of the publication entitled Student Rights and Responsibilities (2) the recommended modifications of the Introduction, Article I, and Article II of the Code of Student Conduct so as to make the Code applicable to the Fort Knox Center, and (3) the application of the balance of the Code (i.e. Articles III through VII) to the Fort Knox Center without further revision.
