with hr. Roberts, Judge Denny and myself. She seemed very
much exercised over the fact that Walker, who took the sten-
ographic report of the testimony in the Towers; case, would
not give up some until he was poid therefor. She seemed to
think that the time was so short within which to file a bill
of eacoptions that the idea of the Commonwealth was to prevent
if possible, the sefence getting a cepy of the testimony. She
mentioned the fact that they had been unable to locate Judge
Robbins, who had gone off to some unknown place. In other wnrdh
she made the impression that she and Powers too were unduly a—
lsrn d. We said to her that of course her attorneys would
look af‘er this matter and that it would be improper for us
to interfere. I promised, however, to let you know the state
of PowersI mind in regard thereto. It may be that Powers has
already communicated with you in regard to same.

I have long felt that leaving out all consideration of partisan
juries, etc. Caleb Powers never had a fair trial. From a consideration
of the indictment against him, the instructions given and the possibility

In venturing to suggest to your consideration my views on this point
you will of course understand that I have no desire to intrude into the
case, and also that I make no pretentious to a knowledge of the criminal
law and further that I have not the record before me. But I write in

. good faith ano believe that it will be so appreciated even if in your judg-
ment it is of small or no value,

The point I make is that the indictment contained two counts, in effect
charging two conspiracies; first, to bring armed men to do an unlawful act,
from whichmthe death of Goebel resulted; second, an actual consyiraoy to
murder Goebel.

Powers was in my Opinion entitled to an instruction that to justify
the jury in returning a verdict of guilty, that the jury should be unanimous
either under the first or second count; or, admitting for argument sake,
that the second count was not repugnant to the first, but possibly might
have grown out of it, etc., guilty on heath both counts. But that it
was improper for the Court to allow the case to go before the jury with~
out an instruction inwflkndingxhimxguilky that to justify a verdict of guilty
they must be unanimous at least on one of the charges brought against him;
because without such.instruction of the consciences of the jurors there
might be a verdict of guilty with six men thinking him guilty under the
first count but not guilty as to the second, while the remaining six
thought him guilty under the second count but not guilty under the first.

This case is not to be confounded with the simple charge of murder,
supported, let us say, largely or altogether by circumstantial evidence .
where some of the jury lay more stress on one circumstance and some on an-
other circumstance but all agree in believing a simple fact, namely, that .
the accused did the killing. It is like Sir Walter Raleigh's case (How—
ard's State Trials), where two conspiracies were charged. I cannot now .
stop to look up the case, but it is sufficient for illustrstion. Let us
suppose that in that case a part of the commission found Raleigh guilty of
the conspiremw to murder the king and.the royal seed, to bring in Arabella
Stuart and set up the Popish religion. The remainder do not believe him
a party to and guilty of that conspiracy but believe him guilty of the con—
spiracy to force the king under the guise of a petition. Now is it not
evident that a verdict of’guilty" would under such circumstances be un~
fightous and illegal. It seems to me that that is beyond question, and I am

not sure but that this feature attaches to the Powers case.

When I say I am not sure it is as to a question of fact, not as to
the law. Powers was in effect charged with two conspiracies and no in»
strution was given, that I recall, as to the necessity for unanimity in
finding him guilty under one or the other or both charges.

The matter is emphasized by the fact that as I remember, you asked
the Court to instruct the jury that there was no evidence to sustain the
charge that Goebel met his death as the result of taking armed men to

Frankfort, and that the Court overruled your motion. In doing this the

Court was either'right or wrong. If wrong, it was a reverseble error, be~

cause even if the jury did not believe that Goebel met hh death as the re-

sult of taking armed men to Frankfort, still the charge tended to inflate

and to very greatly prejudice the jury against the prisoner, and also and '
as s.metter of consequence to give a cumulative value to the evidence against

him on the point of an actual conspiracy, with Youtsey aniothers to murder

Goebel. And this ingredient , so affecting the minds of the jury on the

count of an actual conspiracy to murder was unfair and was illegal be—

cause it might have been removed by a prOper instruction.

But if the Court was right in overruling your motion, it was only
justified in so doing by the fact that there was some evidence to susm
tain the count that Goebel met his death by reasofipoi'Powers hxfiy bringing
armed men to Erenkfort, that his death grew out of that, and was so con"
nected with it as that it made Powers liable fer the consecuences of his
act, as a matter of law, although he may not have intended Goebel's death.
80 be it. Then a part of the jury may have found him guilty on the first
count and a part on the second count. There never has been necessarily
a unanimous verdict by the jury and consequently the verdict shouldugo‘for
naught . ,

The Court refused to give the instruction you asked for. It undertook
to instruct the jury and was bound to give all the law in the case. This
required an instruction as to the necessity for a unanimous agreement on
one or the other count. The court failed to give it, it was absolutely
necessary to a fair trial, and the failure to give it was a fatal error,
for which the case should be reversed.
