      Minutes of the Meeting of the Board of Trustees of the University of
Kentucky, Tuesday, December 14, 1976.





      The Board of Trustees of the University of Kentucky met on Tuesday,
December 14, 1976, in the Board Room on the 18th floor of the Patterson
Office Tower on the Lexington campus with the following members answering
the call of the roll: Mr. William B. Sturgill, Chairman, Professor Michael
Adelstein, Mr. William R. Black, Mrs. Robert 0. Clark, Mr. Albert G.
Clay, Mr. Richard E. Cooper, Mr. John R. Crockett, Mr. John R. Gaines,
Mr. L. D. Gorman, Mr. George W. Griffin, Mrs. David Hermansdorfer,
Mr. Thomas B. Kessinger, Mr. Mike McLaughlin, Mr. Zirl Palmer, Mr.
Frank Ramsey, Mr. Homer Ramsey, Professor Paul G. Sears, and Mr.
James A. Sutherland. Dr. John R. Woodyard was absent from the meeting.
The University administration was represented by President Otis A. Singletary;
Vice Presidents Lewis W. Cochran, Robert Zumwinkle, Stanley Wall, Peter
P. Bosomworth, Raymond R. Hornback, Jack C. Blanton, and Donald B. Clapp;
Dr. Robert M. Drake, Special Assistant to the President; and Mr. John Darsie,
Legal Counsel, Representatives of the various news media were also present.


      A. Meeting Opened

      Mr. Sturgill, Chairman, called the meeting to order at 2:10 p.m. and
the invocation was pronounced by Mr. Michael McLaughlin. Following the call
of the roll, the secretary reported 18 members present and one member absent
and the Chairman declared the meeting officially open for the conduct of
business at 2:15 o'clock.


      B. Minutes Approved

      On motion duly made, seconded and carried, the reading of the Minutes
of the Executive Committee meeting held on October 19, 1976 was dispensed
with and the Minutes were approved as written.


      C. President's Report

      President Singletary called attention to PR 1, his monthly report to
the Trustees, and recommended that the report be received and ordered filed.
Without objection it was so ordered.




 









D. Recommendations of the President (PR 2)



       The items in PR 2, Recommendations of the President, being routine
in nature and there being no questions, on motion by Mr. Black, seconded by
Mr. Frank Ramsey, and passed, PR 2 was approved as a whole and ordered
made an official part of the Minutes of the meeting. (See PR 2 at the end of
the Minutes.)


       E. Supplemental Recommendations of the President (PR 3)

       President Singletary explained that two names had inadvertently been
omitted from the Fall 1976 list of candidates for degrees, which was the next
item on the agenda, and recommended that authorization be given to add the
names of Donald J. Luketi and Judith Stephenson to that list. On motion by Mr.
Homer Ramsey, seconded by Mr. CLay, and passed, it was so authorized.

       The second item in PR 3 recommended extension of Jack B. Hall's
leave of absence for special assignment with state government from January 3,
1977 to January 3, 1978. Mr. Hall is currently serving on Governor Carroll's
staff in Frankfort and President Singletary recommended that the extension
of his leave be approved. On motion by Mr. Cooper, seconded by Mr. Clay,
and passed, it was so ordered. (See PR 3 at the end of the Minutes.)


       F. Candidates for Degrees - University System (PR 4)

       President Singletary recommended that he be authorized to confer upon
each individual named in the attachment to PR 4, plus the two names added to
the list by the Board in an earlier action, the degree to which the individual
is entitled upon certification by the Dean of Admissions and Registrar and
approval by the University Senate that the individual has satisfactorily completed
all requirements for the degree for which application has been made.

      Without discussion, on motion by Mr. Gorman, seconded by Mr. Frank
Ramsey, and passed. it was so ordered. (See PR 4 at the end of the Minutes.)


      G. Budget Revisions for 1976-77 (PR 5)

      Without discussion, on motion by Mr. Clay, seconded by Mr. Griffin
and passed, the revisions in the 1976-77 Budget as recommended in PR 5 were
authorized and approved. (See PR 5 at the end of the Minutes. )

      H. Proposed Amendments to the Governing Regulations (PR 6)

      Noting that the proposed amendments had been received and ordered
tabled at the September 21, 1976 meeting of the Board of Trustees, President

Singletary recommended that they be removed from the table and approved.
It was so moved by Mr. Crockett, seconded by Mrs. Clark, and passed without
dissent. (.See PR 6 at the end of the M inutes. )


       I. Elimination of Registration Fee for University Evening Class Program
          (PR 7)

       As a further step in the University's program of eliminating specialized
fees and in compliance with Standard 9 of the Southern Association of Colleges
and Schools, President Singletary recommended that the $2. 00 special
registration fee charged for classes offered through the University Evening
Class Program be eliminated.

       On motion by Mr. Homer Ramsey, seconded by Mr. Palmer, and
passed, it was so ordered. (See PR 7 at the end of the Minutes. )


       J. Approval "In Principle" of the Paducah Community College General
          Development Plan (PR 8)

       Commenting that the General Development Plan for the Paducah
Community College, which had been sent to the Board members prior to the
meeting, was the twelfth such plan developed for the community colleges,
President Singletary said the only action required of the Board was an
endorsement ''in principle'' of the plan and recommended that this be done.
On motion by Mr. Black, seconded by Professor Sears, and passed, it was
so ordered. (See PR 8 at the end of the Minutes.)


       K. Housing Recommendation (PR 9)

       Both President Singletary and Mr. Blanton discussed the need for the
University to provide additiornal housing for its students and the manner in which
it was proposed that this need be met. It was emphasized that the funding
for the 200 two-bedroom apartment units and the acquisition of three existing
apartments would not be from state money but from the sale of revenue bonds
that would be retired exclusively from housing revenue.

       Professor Adelstein raised a question as to student involvement in the
planning and whether married students could afford to pay the proposed rental
of $200 per month. Mr. McLaughlin asked where the three existing apartments
were located. After Mr. Blanton had answered their questions satisfactorily,
Mr. Frank Ramsey moved adoption of the resolution in PR 9, Mr. Cooper
seconded his motion, and it passed without dissent. (See PR 9 at the end of
the Minutes.)

       L. Report of Results of Alumni Member Election (PR 10)

       President Singletary reported that the three persons receiving the
highest number of votes on the election for an alumni member of the Board of
Trustees were Mr. Thomas P. Bell, Mr. William R. Black, and Mr. William
M. Gant.

       Mr. Sutherland moved that the report of the Secretary of the Board of
Trustees as given by Dr. Singletary, be received and put to record, and that
the Secretary be authorized to certify to the Governor the names of Mr. Bell,
Mr. Black, and Mr. Gant from which list the Governor will appoint a successor
to Mr. Black, whose term expires December 31, 1976. The motion was seconded
by Mr. Kessinger and passed. (See PR 10 at the end of the Minutes.)


       M. Hearing Committee Report (HCR's 1 and 2)

       Mr. Black, Chairman of the Board of Trustees Hearing Committee,
reported that the committee had met to consider two cases. In the first case,
that of Mr. Robert Arlett, whose contract of employment terminated at the
end of the 1974-75 academic year, the Hearing Committee recommended (1)
that the case not be re-heard by the Board of Trustees, and (2) that the Board
take no action to reverse the previous decision regarding the renewal of Mr.
Arlett's contract beyond the 1974-75 academic year. Mr. Black moved
acceptance of the report. His motion was seconded by Mr. Palmer and passed
without dissent.

       The second case involved the petition of Mr. Thomas C. Knuckles,
relative to his disability payments. The Hearing Committee recommended, and
Mr. Black so moved, that the Board find that Mr. Knuckles has received
disability payments in accordance with the established policies of the Board of
Trustees and that the Board affirm the previous administration judgment made
in this case. His motion was seconded by Mr. Frank Ramsey and passed without
dissent. (See HCR's 1 and 2 at the end of the Minutes.)


       N. Investment Committee Report (ICR 1)

       Mr. George W. Griffin, Chairman of the Investment Committee, reported
that his committee had met with the University's investment advisors and was
satisfied with the manner in which the investment program was being handled.
He moved that the report on investments for the quarter ending September 30, 1976,
be accepted. His motion was seconded by Mr. Home r Ramsey and passed
without dissent. (See ICR 1 at the end of the Minutes. )

       0. Interim Financial Report (FCR 1)

       Mr. Griffin, representing Mr. Clay, who had been unable to attend the
meeting of the Finance Committee on the morning of December 14, moved that
the Interim Financial Report for the period ending October 31, 1976, be
accepted. His motion was seconded by Mr. Black, and passed without dissent.
(See FCR 1 at the end of the Minutes.)


       P. Easement (FCR 2)

       Mr. Griffin explained that the Finance Committee had considered the
request from the Lexington-Fayette County Health Department for an easement
for roadway purposes across the University property on the Leestown Road
and recommended that the easement be granted, and he so moved. His motion
was seconded by Mr. Crockett and passed without dissent. (See FCR 2 at the end
of the Minutes. )


      Q. Authorization for Incineration of Paid Bonds and Coupons (FCR 3)

      Mr. Griffin moved that the recommendation in FCR 3 providing for the
incineration of paid bonds and coupons be approved. His motion was seconded
by Mr. Clay, and passed without dissent. (See FCR 3 at the end of the Minutes.)


       R. Meeting Adjourned

       After first asking the members to remain following the meeting in order
to have a picture taken, Mr. Sturgill called for a motion for adjournment. The
motion was duly made, seconded, and carried, and the meeting adjourned at
2:55 p.m.

I.    Patent Assignment

      Recommendation: that authorization be given to the proper officials
      of the University of Kentucky Board of Trustees to execute an assignment
      on behalf of the Board of Trustees to the University of Kentucky Research
      Foundation of the following application for Letters of Patent of the
      United States and the invention represented thereby: George A.
      Digenis & Manvendra B. Shambhu, Serial Number 703, 319, filed
      July 8, 1976.

      Background: George A. Digenis & Manvendra B. Shambhu have
      invented improvements in Tobacco Smoke Filter Material. They have
      assigned their rights to the invention to the University. In accord
      with usual practice it is recommended that the University assign the
      patent to The University of Kentucky Research Foundation.


II.   Patent Assignment

      Recommendation: that authorization be given to the proper officials
      of the University of Kentucky Board of Trustees to execute an assignment
      on behalf of the Board of Trustees to The University of Kentucky
      Research Foundation of the following application for Letters Patent
      of the United States and the invention represented thereby: John T.
      Bryans, Serial Number 722, 817. filed September 13, 1976.

      Backgroundd: John T. Bryans invented an Inactivated Equine Rhino-
      pneumonitis Virus Vaccine. He has assigned his right to the invention
      to the University. In accord with usual practice it is recommended
      that the University assign the patent to The University of Kentucky
      Research Foundation.


III.  Appointments and/or Other Staff Changes

      Recommendations: (1) that approval be given to the appointments and/or
      other changes which require Board action; and (2) that the report

       relative to appointments and/or changes already approved by the
       administration be accepted.

       Background: The following recormmended appointments and/or other
       staff changes require approval by the Board of Trustees in accordance
       with Part VIII-B of the Governing Regulations of the University.
       These recommendations are transmitted to the Board by the
       appropriate vice president through the President and have his
       concurrence.

       Under the Governing Regulations the authority to make certain
       appointments and/or other staff changes is delegated to the President
       or other administrators who are required to report their actions
       to the Board. This report follows the recommendations requiring
       Board approval.
