The Board of Trustees of the University of Kentucky met in regular statutory session at 2:00 o'clock (Eastern Daylight Time) on Tuesday, September 21, 1976, in the Board Room on the 18th floor of the Patterson Office Tower on the Lexington campus with the following members answering the call of the roll: Mr. William B. Sturgill, Chairman, Professor Michal Adelstein, Mr. Williarm R. Black, lMrs. Robert 0. Clark, Mr. John R. Crock-ett, Mr. L. D. Gorman, Mrs. David Hermansdorfer, Mlr. Thomas B. Kessinger, Mr. Michael -McLaughlin, Mr. Zirl Palmer, kr. Frank Ramsey-, Mir. Homer Ran.se, Professor Paul G. Sears, MIr. James A. Sutherland, and Dr. John R. Woodyard. Absent from the meeting were Mr. Albert G. Clay, fir. Richard E. Cooper, Mr. John R. Gaines, anti Mlr. George W. Griffin. The University administration was represented by President Otis A. Singletary; Vice Presidents Lewis W. Cochran, Robert Zumwinkle, Stanley Wall, Peter P. Bosomwvorth, Raymond R. Hornback-, John T. Smith, Jack C. Blanton, and Donald B. Clapp; Dr. Robert Mvl. Drake, Special Assistant to the President, and MIr. John Darsie, Legal Counsel. Representatives of the various news media were also present. A. Meeting Opened Mr. Sturgill called the meeting to order at 2:00 p.m,. and the invocation was pronounced by Mr. Sutherland. Following the call of the roll, the secretary reported a quorum present, and the meeting w.as declared officially open for the conduct of business at 2:03 o'clock. B. Minutes Approved On motion duly made, seconded, and carried, the reading of the Minutes of the meeting of the Executive Committee of the Board of Trustees on August 10, 1976, was dispensed with, and the Minutes were approved as published. C. Report of Nominating Committee Mr. Sturgill requested Professor Paul Sears to assume the chair to receive the report of the Nominating Committee. Mr. Homer Ramsey, Chairman of the Norninating Committee composed of Mr. Ramsey, Ivir. Crockett, and Mvr. Kessinger, placed the name of Mr. William B. Sturgill in nomination as Chairman of the Board of Trustees, and he was duly elected. Mr. Sturgill -2- resumed the chair, and the following names were placed in nomination by Mair. Ramsey and all were duly elected to the offices designated: Albert G. Clay, Vice Chairman; Paul G. Sears, Secretary; Betty Carol Clark, Assistant Secretary. For members of the Executive Committee the following names were placed in nomination by Mr. Ramsey: Mr. William B. Sturgill, Mr. William R. Black, Mr. Albert G. Clay, Mr. Richard E. Cooper, and Mlr. George W. Griffin, and all were duly elected. It was noted that Professor Paul Sears as Secretary of the Board would serve as Ex-Officio Secretary of the Executive Committee. D. Committee Appointments for 1976-77 Mr. Sturgill announced committee assignments for the 1976-77 year. A list of the committees appears at the end of the Mlinutes. E. President's Report to the Trustees (PR 1) President Singletary did not discuss the items in his monthly report of University activities but dlv reconmmend that the members read the report at their leisure. Ir. Sturgili accepted the report, and it was ordered filed. F. Recominendations of the President (PR 2) Indicating that the items in PR 2, Recommendations of the President, were routine in nature, President Singletary recommended approval. On motion by Mr. Black, seconded by Mr. Palmer, and passed, recommendations in PR 2 wevere approved and ordered made an official part of the Minutes of the meeting. (See PR 2 at the end of the Minutes. ) G. Approval of Degree Candidates (PR's 4 and 5) President Singletary noted that PR's 4 and 5 recommended approval of degree and/or certificate candidates who completed their work at the close of the summer session for both the University System and the Community College System. On motion by Mr. Palmer, seconded by MvIrs. Clark, the individuals recommended for degrees and/or certificates in the trio systems were approved contingent upon certification by the proper authorities that ali requirements for the degrees and/or certificates had been satisfactorily completed. (See PR's 4 and S at the end of the Minutes. ) -3- H. Approval of Capital Construction Projects (PR 6) President Singletary recommended approval of PR 6, Capital Construction Projects. He added that if there were any questions, Mr. Blanton would be happy to answer them. There being no questions, on motion by Mr. Sutherland, seconded by Mr. Kessinger, and passed, the three capital construction projects recommended in PR 6 were approved for submission to the Council on Public Higher Education. (See PR 6 at the end of the Minutes. ) I. Public Safety Division at Jefferson Community College Established (PR 7) Noting that the 1976 Legislature repealed, effective January 1, 1977, the statute authorizing the security force at Jefferson Community College to operate as "special local police officers", President Singletary recommended that the Board of Trustees in accordance with KRS 104. 950-164. 990 establish a safety and security department to be known as the Jefferson Community College Public Safety Division effective immediately. On motion duly made, seconded and carried, the recommendation in PR 7 establishing the Jefferson Community College Public Safety Division was approved. (See PR 7 at the end of the Minutes.) J, Budget Revisions for 1976-77 (PR 8) Without discussion, on motion by Mr. Homer Ramsey, seconded by Mr. Black, and passed, the revisions in the 1976-77 Budget as presented in PR 8 were authorized and approved. (See PR 8 at the end of the Minutes. ) K. Proposed Amendments to the Governing Regulations -PR 9) The next item on the agenda presented certain proposed amendments to the Governing Regulations which President Singletary recommended the Board receive for consideration and action at the next regular meeting of the Board. Mr. Sturgill recognized Professor Sears, who moved that the first recommended amendment to change Part X-A (Page 31) be amended as follows: 1) delete the suggested addition (physical or mental handicap) from the second sentence, 2) add a third sentence which would read "Additionally, the University shall not discriminate against any applicant for employment because of physical or mental handicap in regard to any position for which the applicant for employment :s qualified. " 3) start a new paragraph with the next sentence, "Members of the Board of Trustees.... ' His motion was duly seconded and the amendment to the first proposed amendment was approved. -4- The motion was then made that the proposed amendments as amended be accepted by the Board for consideration at the next regular meeting of the Board. Mr. Crockett seconded the motion and it passed without dissent. (See PR 9 at the end of the Minutes. ) L. Audit Reports for 1975-76 Accepted (FCR 1) Mr. Sutherland, acting for Mr. Griffin, Chairman of the Finance Committee, recommended that FCR 1 be approved as presented. His motion was seconded by Mr. Palmer and passed without dissent. (See FCR 1 at the end of the Minutes. ) M. Revision of Policy Statement on Refunds to Students Upon Withdrawal from Certain Classes (FCR 2) After a brief explanation, Mr. Sutherland moved that the recommendation in FCR 2 be approved. His motion was seconded by Mr. Gorman and passed without dissent. (See FCR 2 at the end of the Minutes.) N. Patent Assignment Recommendation: that authorization be given to the proper officials of the University of Kentucky Board of Trustees to execute an assignment on behalf of the Board of Trustees to the University of Kentucky Research Foundation of the following application for Letters of Patent of the United States and the invention represented thereby: Sudhakar Neti and Roger Eichhorn, Serial Number 690, 838, filed May 28, 1976. Background: Sudhakar Neti and Roger Eichhorn have invented a Dual Beam Two Colrponent Laser Doppler Velocineter With Polarized Bean-s. They have assigned their rights to the invention to the University. In accord with usual practice it is recommended that the University assign the patent to the University of Kentucky Research Foundation. II. Appointments and/or Other Staff Changes Recommendations: (1) that approval be given to the appointments andlor other changes which require Board action; and (2) that the report relative to appointments and/or changes already approved by the administration be accepted. Background: The following recommended appointments and/or other staff changes require approval by the Board of Trustees in accordance with Part VIII-B of the Governing Regulations of the University. These recommenda- tions are transmitted to the Board by the appropriate vice president through the President and have his concurrence. Under the Governing Regulations the authority to make certain appointments and/or other staff changes is delegated to the President or other administrators who are required to report their actions to the Board.
