NOTICE TO ALL EMFLOYES
Subject: UNIFORM WORKWEEK
In administering the Fair Labor Standards Act, the Walsh—Healey Public
Contracts Act and Executive Order 9240, the United States Department of Labor 4
uses the "workweek" as the basis for computing straight-time pay, overtime pay,
and premium pay due to employes.
"Workweek" and "work-schedule" are not the same. A workweek is perme—
nent and always consists of seven consecutive days commencing on the same day and
hour of each succeeding calendar week. It is the fixed period used by employer
and employes to determine when overtime is due because more than 40 hours have
been worked and also to determine the sixth and seventh days of the workweek for
premium pay purposes. It is essentially an accounting standard.
On the other hand, the "work-schedule" is the oral or written plan which
indicates the days and shifts upon which employes are expected tc work. The werk-
schedule usually calls for work on five or six of the seven days which comprise
the workweek. The work—schedule may, however, call for less than five days of the
workweek or it may include all seven days in cases of emergency. An employe's
work—schedule may be the same week after week or it may change from time to time.
To remove any uncertainty as to the workweek in effect at the Wisconsin
Steel Coal Hines and to establish the workweek with the definiteness contemplated
bv the Department of Labor’s rulin s and inter retations the Com-an* hereby noti-

fies all employes that effective Monday, January 22, l94S at 6:50 A.M., the work-
week for all employes will commence with the hour fixed for the start of the regu-
lar first shift (6:30 A.H.) on Monday of each week.
If any employe's tide has previously been calculated on the basis of some
other workweek, his compensation for the last week prior to the change to the new
workwoek will be computed on the old or new basis, whichever is more favorable to
the employe.
Obviously, the establishment of the fixed workwcck commencing at G;F0 A.H.
of Icnday of each week, and making the same applicable to all employes, will have
no bearing whatever on present or future work schedules.

Just before noon to day (Sunday) I received the following wire from
Mr. C. J. Potter, Deputy Solid Fuels Administrator, dated Washington
January léth 1945-
"Current need additional tonnegos Southern Appalachian coals
makes essential that extra operating time made effective
in Districts 7 und 8. Request Operations two Sundays,
January 23th and Februdry llth Districts 7—EEE»§i“"UEited
Mine Workers support proposal (with) double time paid miners
seventh dey. Have proposed to O P A temporary price
increases as follows: District 7, domestic sizes five (5¢)
cents; other sizes Ten (10%} cents. Liitriot B, five (Ed) cents
for all sizes. 0 P A actively considering price increases
applicable entire month of February (for) Mines engaged two
Sunday Operations. Appreciate wire January 15th how mady——
mines will operate your sseooi¤tion."
I think the above wire is clearly understandable. It simply means
that the Solid Frels Administration is requesting our Mines to
operate on Sunday! J@nu;£yA28 and Qunday, February lltb provided
0 P A epproves the incress5E*sug@osted by Solid Fuels and further
provided that the Mine Workers will work on these two Sundey's.
You will also note that Solid Fuels is requesting O P A to extend
the increases suggested for the entire month of February 1945
to those mines that operate on the two Sundays requested.
Since this is o request from the Solid Fuels Administration it is
my personal opinion that every Operator should exert himself to
comply mit? ·*’. the request and to offer his ewployees work on these
specific Sunday's. Apparently the coal is badly needed and to decline
to make effort to ogorste would no doutt be considered an not of
ignoring the request end at the same time an unpatriotic step.
You will further note that Mr. Potter requests an answer as to how
nmny operators will comply with the request on Monday, January 15th
- end I imagine he has fixed this date so it will be far enouqh in
edvrnoe to givo O P A ample tire to consider the proposed price
increases.
Please advise me your decision sometime Monday the 15th.
