I 7‘ THIS LEASE, nade and entered into as of the lat day of
May, 1955: by and betveen £§E§§2_§2§§£_§2§§§§1, Vheelwright,
Kentucky, party of the first part, hereinafter referred to as
I Lessor, and 1K, H. E. MIDKIFF, Prestonsburg, Kentucky, party
of the second part, hereinafter referred to no Lessee;
.‘ WITNESSETE: That Lessor, in cossideration of the rents
and covenants hereinafter stipulated, to he paid, kept and
V - performed by the Lessee, does hereby demise, lease and let unto
. said Lessee, to be used solely for the purpose of maintaining
and conducting therein the business of Optometry, that certain I I
I room in the TelephOne Building belonging to the Lessor and
. situate in the Town of Wheelwright, Floyd County, Kentucky.

This lease shall be and rennin in full force and effect
for a period of one year from the date hereof, and after May
1, 1956 shall continue in effect fron month to month unless
either party gives notice of cancellation to the other party

I thirty days in advance of the date of cancellation.
Lessee, in consideration of the foregoing lease and the
t privilege of maintaining and operating the above described
_ business in the denised premises, covenants to and with Lessor
_ as follows:

‘ (1) To pay Lessor Five Dollars ($5.00) per month for
rental. Such charge is to be paid not later than the 15th day
of the month following the month in which such charge is
incurred.

(2) To take good care of the premises and equipment and
return same at the termination of this contract in as good
order as received, ordinary wear and tear excepted, unless
the building and equipment should be destroyed or damaged by
fire or lightning, or other natural causes; and further agree

 not to assign this lease or underlet said premises or make
‘ any alterations therein or thereto without the written consent
of the Lesser.
(3) Lessor retains the right to add to and make any I
- ' repairs to the demised premises at any time or to any extent
I which it may deem necessary, but will make such repairs at a I
tins and in a manner so as not to unreasonably interfere with I
the operatioa of the leased premises by the Lessee, for the L
' purposes hereinabove est forth. I?
. (k) The premises leased shall be used for the purposes I
herein mentiOned only and not for any immoral or illegal or I
other purposes. i,
(5) Any cancellation of this lease by the Lessor shall i
be without prejudice to the right of the Lesser to recover from .
I the Lessee all rents and other charges due to the time of such
cancellation. i
(6) For violation of any of the provisions of the pre- 5 I
ceding numbered paragraphs, this lease may be cancelled by i
Lessor, at its option, by vritten notice to Lessee, which notice I
. may be given by letter duly nailed, regardless of any other
termination or surrender clause in this agreement.
(7) Lessee shall surrender innediate possession of the
premises herein leased to the Lessor, on the termination or
I this Issue, for any cause herein provided.
(8) Lessor shall have the privilege to enter the leased
premises at any and all reasonable times for the purpose ofin-
apection and for all other proper purposes.
(9) If the Lessee should die or become totally and
permanently incapacitated for any cause, then this lease shall
thereupon be automatically terminated and cancelled.

. (10) Losses, in the use and occupancy of the premises I
