Kentucky, as shown on map or plat in File 348, Floyd County Court
Clerk‘s Office, and improvements thereon except as hereinafter set .
out, for the sum of $2,000.00 , and, in addition "Buyer” shall
pay the sum of $165.00 closing costs and $30.00 fer survey plat to.
be supplied by ”Owner”, all of which is to be paid as follows:

It is agreed that time is of the essence of this agreement
and that this transaction shall be closed, all money due hereunder
shall be paid to ”Owner" and the deed herein provided for shall be

”Buyer” does no pay the balance as herein provided on or before
the closing date then the down payment herein provided shall be
retained by "Owner" as liquidated damages hereunder, and this

Taxes at the rate of $1.50 per $100.00 of selling price shall
be prorated to the date of closing and taxes for the unexpired portion of
the year following date of closing shall also be paid by ”Buyer” to
”Owner" on closing. All unpaid rents and utility bills due "Owner"
shall also be paid at date of closing.

in wheelwright, Floyd County, Fentucsy; that said re;idencc was
supplied with gas through a was distribution system owned. operated;
maintained and controlled by the defendant.

(2) That the defendant, by and trowrh its avnnts. servants
and employee», acting within the :cu e of their employment, so
carelctsly. recklessly and nerliqently operated and haintained

- the gas lines into said residence .4 to allow and permit quanti~
ties of gas to escape and circulate in, around. under and throuqh
said rosidonqe and that as a direct and proximate result of such
negligence said residence was demolished by an explosion of gag,
tesultkng in seven ingurios to him about his person.

(3) That by reason thereof he has been damaged in the

Dear sir:

As you know me and my daughter sustained injures in the hOASG
explosion last September 12, 1967 and both of us have been
hospitalized, and I must go back for surgery in January 1968 at
the Good Samaratin Hospital at Lexington, Ky.

As you know I got three months behind with my house rent and
your hatchett man Thompson got very rude with my wife and threatened
to cut off the utilitys unless the house rent was paid the next day.

My son paid the rent of which I could not have done because
I have been unable to work since the explosion, but I called my
attorney and he said you said you had insurance to cover my house
rent or any other loses that I may have had from the einlosion.

I expect a settlement with your insurance with in the next
two months or so and I will asure you I will pay all rent due you
and all other expense I may owe you at that time.

I was in the hospital at the time Mr. Thompson got so rude
with my wife and I have never seen him yet but I intend to.

After I am released from the doctors I intend to go back to
work and continue being a citizen of Wheelwright.
