Dear John:
Enclosed is the new deed to Lot 29 of Wheelwright, running to
Harry Bartuka and Marlene Bartuka, his wife. This deed was request-
ed by Mr. Bartuka to take the place of the original deed running to
him alone.
As I understand it, the original deed has been delivered to Mr.
Bartuka but has not been recorded. Under these circumstances -
BUT ONLY UNDER THESE CIRCUMSTANCES can an exchange of dead be
made. Do not deliver the enclosed deed to Mr. Bartuka until you
have picked up, from him, the original dead running to him alone.
The original of that deed should be mailed by you to us.
Before delivering the enclosed deed to Mr. Bartuka, examine the
original he is going to return to you, to make sure it has not
been recorded. If it has been recorded do not, under any circum-
stances, give him the enclosed deed. Instead, return it to us.
The procedure for getting title out of Mr. Bartuka's name and
into the name of himself and wife is quite different from that

~ outlined above if the deed to Bartuka alone has been recorded.

deliver to you the following executed deed to the above captioned lot,
running to Harry Bartuka, Grantee.
You are to collect the full amount of the purchasa price shown in the
deed and remit 80% thereof to Island Creek Coal Company, in accordance
Mdth their disbursement letter on this transaction. In addition, you
are to collect from the purchaser the sum of $30.00 for the plat to the
property being sold, and $25.00 attorney's fee for the preparation of
deeds and other instruments (if any).
The deed is to be recorded at the expense of the purchaser, recording
fee for the release is to be charged against Mountain Investment's
share of the proceeds of sale, as is the tax due the State of Kentucky.

FROM: Gordon Brown SUBJECT: Deed to Lot No. 29
Dear John:
Enclosed is the new deed to Lot 29 of Wheelwright, running to
Harry Bartuka and Marlene Bartuka, his wife. This deed was request-
ed by Mr. Bartuka to take the place of the original deed running to
him alone.
As I understand it, the original deed has been delivered to Mr.
Bartuka but has not been recorded. Under these circumstances —
BUT ONLY UNDER THESE CIRCUMSTANCES can an exchange of deed be
made. Do not deliver the enclosed deed to Mr. Bartuka until you
have picked up, from him, the original deed running to him alone.
The original of that deed should be mailed by you to us.
Before delivering the enclosed deed to Mr. Bartuka, examine the
original he is going to return to you, to make sure it has not
been recorded. If it has been recorded do not, under any circum-
stances, give him the enclosed deed. Instead, return it to us.
The procedure for getting title out of Mr. Bartuka‘s name and
into the name of himself and wife is quite different from that
outlined above if the deed to Bartuka alone has been recorded.
