‘ ' _ Mr. Recktenwald has never reported a gas leak to
»Mountain Investment, lnc. Afle had reported a sewer problem and
. a leaking faucet. Upon investigation, maintenance men of
Mountain Investment, Inc. distovered that-the floor drain in
“ the basement of his house was stopped-up with sawdust and my
’ client therefore declined to pay Mr. Recktenwald's claim for
a. damage to his tools located in his basement. Mr. Recktenwald
1 f then took the position that he was not going to pay his utilities
until Mountain Investment, Inc. paid for his tools. He was advised
~_ by the resident agent of Mountain Investment, Inc. that if his _ ,
utilities were not paid his seiVices would be turned off.‘ He ‘ '
, failed to pay, his services were turned off, and he reconnected
his water service using a garden hose. I am also advised that he
turned his gas service back on. On August 24, 1974 Mountain -
Investment, Inc. received a total of three checks from Mr.
2 Recktenwald in the amount of $172.83. MOuntain Investment, Inc.
~ ‘ still is holding one of the three cheeks, in the amount of $70.00
. as there was insufficient funds in his account to pay this check.
' '.In an effort to be reasonable, Mountain Investment, Inc. turned
* on his utilities upon receipt of his checks.

‘ . On August 8, 1974, Mountain Investment, Inc. had a
gas survey made by Southern CrOSs Corporation and there was no
reported leak at James Recktenwald's residence.

‘ Mr. Recktenwald paid his utility bill for November,
1973 on December 10, 1973. His bill for the month of December,
1973 was $26.52; for January, 1974 $29.04, with a late charge
in the amount of $2.36 attributable to the previous balance of
$26.52; for February, 1974, $32.40 with a late charge of $2.60
. attributable to the existing balance of $57.92; for March, 1974
$23.16, with a late charge‘of tz.91 attributable to the preVious
balance of $63.88 as $29.04 was paid on February 19, 1974; for
April, 1974, $25.68, with a late charge of $2.92 on previous
balance of $63.88; for May, 1974, $20.64 with a late char e of
$2.28 on the existing balance of $92.48; for June, 1974, $18.96
. with a late charge of $1.63 on the previous balance of $115.40;
for July, 1974 $18.12, with a late charge of $1.56 on an exist»
ing balance of $135.99; and for August, 1974, $15.60 with a late
. charge of $1.56 on an existing balance of $155.67, for a.tota1
of $172.83. As I indicated hereinbefore, this sum was allegedly
paid by three checks delivered to Mountain Investment, Inc. on
August 24, 1974, whereupon his utilities were turned on. One of
his three checks, in the amount of $70.00 has been returned be-
cause of insufficient funds.

When you write Mr. Recktenwald's counsel, you might
choose to advise him of the existence of Kentucky Revised Statute
433.521 and 433.524. By way of explanation to Ms. Janice Grigsby
and Mr. Gordon Brown, KRS 433.521 provides for a fine of not less '
than $50.00 nor more than $500.00 or imprisonment for not less ‘
than 3 months nor more than 12 months, or both, for the unlawful

' conversion of water, electric current or gas. KRS 433.524 pro~

vides the same punishment for any person who knowingly accepts

and receives the use and benefit of water, electric current or

gas diverted in violation of the preceding statute. -

Dear Sir:
Enclosed is a copy of a letter to the Public
Service Commission concerning one of our tenants, a I
Mr. James Recktenwald. Mr. Reckeenwald has never reported
a gas leak. He has, however, reported a sewer problem '
and a leaking faucet. He tried to charge the Company
with damages for some tools getting wet in his basement.
Our maintenance men reported that the floor drain in the
basement was stopped up with sawdust and we notified
Mr. Recktenwald that we were not responsible for anything
in the basement of his house. He then refused to pay
his utilities until we made an adjustment. I told him
there wouldn't be any adjustment made and if he didn't
pay his utility bills that they would be shut off. We
turned the services off and he turned them back on. We
took the meters off and he reconnected them using hose.
I doubt that he has ever been without gas and water
except for the time it took for him to reconnect them. He
came in Saturday, August,24, 197% and paid his bills.
We had a total of three checks he had written for a total
of $172.83. We still have a $70.00 check as there were
insufficient funds in his account to cover it at his bank. ‘
I instructed our maintenance men to turn his utilities
back on before I learned the check wasn't good. In my
opinion Mr. Recktenwald has been very unreasonable in his
demands.

In regards to the gas leak, a gas survey was
made on August 8, 1974 by Southern Cross Corporation and
there was no gas leak at James Recktenwald‘s residence.

Enclosed also is a record of JAmes REcktenwald's
payments on his utility bills.
