of the Government; that the purchase price shall be paid at the time of recording such deed; and that said lands, including

7. Taxes, water assessments and other general and special assessments of whatsoever nature for the year in which the
closing of the transaction takes place shall be prorated as of the date of the closing of the transaction, it being expressly
agreed that for the purpose of such proration the tax year shall be deemed to be the calendar year. If the closing of the
transaction shall occur before the tax rate is fixed, the apportionment of taxes shall be on the basis of the tax rate for the
next preceding year applied to the latest assessed valuation.

Dear Mr. Cooley:
House No. 219 was sold April 27, 1971 t- Bradie Calvin and Ola Mae
Colvin, his wife.
The full amount of the purchase price was $3,568.00. A down pay-
ment of $68.00 was received by our Wheelwright office and deposited
to our non—operating account in the Pikeville National Bank. The
balance of the purchase price, viz. $3,500.00, plus $30.00 reimburse- ~
ment for plat cost and $38.00 reimbursement for closing costs, was
collected by the First National Bank of Prestonsburg at time of
closing. From these amounts $2,000 was sent to the Liberty National
Bank and Trust Company to apply on the principal of our mortgage
loan, also interest in the amount of $35 85 and $4.50 covering the
fee for recording the release of mortgage, leaving a balance of
$1,459.65 which was deposited to our account in the First National
Bank of Prestonsburg.
Cost of this house to us was $978.00. The enclosed photocopy of the
deposit slip dated April 27, 1971 from the First National Bank of
Prestonsburg will confirm the foregoing.

 THIS DEED OF CONVEYANCE made and entered into as
of April. 8th l9 '71, by and between Mountain
Investment, Inc., a Kentucky Corporation, party of first part, and

Brodie Colvin and Ole Mae Calvin, hie wife

WITNESSETH: That for and in consideration of the sum
of Three Thousand Five Hundred Sixty Eight & oo/lOO (3,508.00)
Dollars cash in hand paid, and other valuable consideration, the receipt
and adequacy whereof is hereby acknowledged, party of first part does
hereby bargain, sell, grant, convey, transfer unto second parties, their
heirs and assigns, the following described property to-wit:

A tract or parcel of land lying and being in Floyd
County, Kentucky an Otter Creek of Left Beaver Creek in
the Town of theelwright and being Lo; No. 219, includ-
ing the Dwelling House and appuutenance thereunto be—
longing, located on said lot at parcel of land of the
Wheelwright Subdivisi n as 333;; D, f;.;; party's map
or plat in File No. 346, Records of the Floyd County
Clerk's Office.

Being part of the same property cznveyed to past;
of the first part by Island Creek Coal Company by Deed
dated November 9, lgbo and recorded in Deed Book 191 at
page 504, Records of the Floyd County Court Clerk's
Office.

This conveyance is subject to the exceptions and reserva—
tions contained in those two instruments of conveyance from Island Creek
Coal Company to party of the first part, referred to herein for source of
title and which are dated November 9, 1966, and recorded in Deed Book 191
at page 501 and at page 504, and ALSO in those certain deeds executed by
party of the first part to Harold Telephone Company and Tel-Com, Inc.,
dated June 15, I967 and recorded in Deed Book l93 at pages 27], 273, and
275, records of the Floyd County Court Clerk's office, and ALSO deed of
conveyance from first party to Kentucky Power Company dated December 29,
1967, and of record in Deed Book l95 at page #25, records of the Floyd
County Court Clerk's Office.

 First Party hereby further reserves a right of way
and easement with right of egress and ingress and entry on and over
said premises for the purposes of maintenance, operation, repair, re-
placement, relocation and removal, in whole or in part, of any and all
of the water, gas, electric, telephone and CATV lines and cables, sewer
mains, connections and service lines as now located on said premises in
its operation of said facilities, which right of way and easement shall
endure as long as said systems or any part thereof are operated by
first party, its successors or assigns.

TO HAVE AND TO HOLD unto the parties of second part,
their heirs and assigns forever, with covenant of General Warranty of
Title, subject to the exceptions and reservations contained herein,
