. PREFACE
The Historical Records Survey began in January, 1936, as a part of
the Writers' Project of the Works Progress Administration, and became in
Dctober of that year an independent part of Federal Project No. l. Un—
der the national leadership of Luther H. Evans, formerly of Princeton, the
Survey has inventoried state, county, city, church, and, to a limited ex-
tent, private records. At present, it is preparing for publication in a
condensed form, descriptive lists of public records of the local units
of government. In each state the counties are numbered in alphabetical
order, and treated as separate units, each with an introductory section
giving the historical background and a description of the present govern-
ment and records system, All records are organized under the office of
origin, which is carefully described as to history, functions, and re-
quired records. Each type of record is given a numbered entry showing
the comprehensive dates for which it is extant, the quantity, an inter- l
pretation of contents, and details as to nature of recording, indexing {
and location. State, municipal, church, and other records will be dee ·
scribédiincapparaterpuhlications. f
· The Historical Records Survey was begun in South Carolina on March
l, 1956. From the beginning it has‘had the active aid and cooperation
of the University of South Carolina, thanks to Professor Robert Li Meri-
wether, head of the department of history. The Lee County unit’could
not be manned until late summer, when, after exhaustive canvass, Miss
Tdzrrict Byrd of Iynchburg was located. On August 51 she began work in
PHG courthouse, under the supervision of Mrs, Mae Higginbotham of
Florence, then acting as area supervisor, Mr. L. W. Moore, clerk of
cctrt, and Mrs. we N. McLeod, his assistant, were particularly kind in i
cxplaining the records to the young worker. By October 14, the field
vcr; on county and town records had been completed, and Miss Byrd was
transferred to Columbia as senior research assistant, to work in the
state office of the Survey. The legal and historical research and the
preparation of introductory material is the work of the state office. ‘
The forty-six separate units of the Inventory of Bounty Archives of
Sguth Carolina will be issued in mimeographcd form for free distribution
To State and local public official: and to a selected QTCUP of public

HISTORICAL SKETCH OF LEE COUNTY
The settlement of Lee County dates from about the year 1740, when pio-
neers of British stock began moving up into the region from Williamsburg.
Loosely a part of the vaguely defined, unorganized Craven County, originally
named by the Lords Proprietors, this area was placed in Camden District by
the circuit court act of 1769. Later it was included in the subdivisions of
Camden District when Claremont and Clarendon counties were created in 1785
(Stat. IV, 662). Portions of these two counties were cut off in 1792 and
teresa into Salem County, with Lynches Creek, Black River, and "Scape Whore" I
Swmnp as natural boundaries, on practically the same lines as modern Lee Coun-
ty. `The commissioners named to fix the location of the court house and jail
were James_Dickey, Thomas Willson, John Singleton, Thomas Chandler, and John
M»Kelveen (Stat. V, 2l6~l7). In 1798, when Camden District was dismembered,
, Salem, Claremont, and Clarendon counties were combined into Sumter District,
(Stat} VII, 284). Salem court house was built (Stat. IX, 585, 588) and coun- Q
tv`cburts presided over by justices of the peace and of the quorum, sitting :
I as a group in regular sessions, were held (MS Minutes Camden District, 1795·99, 2
pp. 56, 57) until the system was abolished in 1800 (Stat. VII, 291). Salem .
as a subdivision of Sumter District (R. Mills, Atlas of the State of South
§y§Qlg§g"_,, Baltimore, 1825) continued to exist (Stat. XI, 268), with local
jdetices of the peace and of the·quorum (Stat. V, 552, 675), road com ission-
ers*(§taty IX, 585, 446, 527, 556), com issioners of the poor (ibid. 454), and `—
tax collectors (Stat. VI, 426). Since justice was to be dispensed by the dis-
~ttiet,~the county court records were directed to be removed to the Sumter
court house (Stat. VII, 298), where the Salem County records were probably
j burned with those of Claremont and Clarendon in 1801 (Stat. V, 402).
_ Sentiment for a local govermental organization persisted, n¤wever,s
and an unsuccessful effort was made to revive old Salem County under the
name of DeKalb (A. W. Dick, G. R. McElveen, L. M. Peebles. Lee County Eco}
ggmngajgggjgygygl, Columbia, 1925. pp. 5-15). In 1897, an act was passed to
create the county under the name of Lee, in honor of General Robert E. °
Loo._ Boundaries were surveyed cutting territory from Kershaw, Darling-_
· ton, and Sumter (Stat. XXII, 908-15), county officers were elected, and
the legislative delegation was seated (Stat. XXIII, 211, 541). But Darling-
ton County contested the legality of the act, and the state supreme court'
annulled it on the ground that the election had not been duly attested by
the com issioners of elections (Columbia, S. C. State, Nov. 21, 1898; Jah.)

By law, no further effort_cou1d be made for four years; so it·was
not until February 25, 1902, that Lee County was formally established.‘
The boundaries named Lynches River, Black River, Scape 0*er Swamp, Sparrow
Swamp, Long Branch, and Screeches Branch, but followed in the main artie
ficial lines through Kershaw, Darlington, and Sumter, as surveyed in 1898
(§jgt. XXIII, 1194-96). In 1914, a small area was restored to Sumter (gptg,
p. 647); in 1921, Turkey Creek Township was enlarged at the expense of Kcr— ·
1 Shaw (Apts, p. 259); and in 1925 the boundary was again shifted to return
1.58 square miles to Kershaw·(é£ts, p. 12). The act‘of‘1902 named W. A.
James, J. E. McCutchen, U. R. Shaw, Edwin Wilson, W. M. Kelley, A. E. Skinner,
A. M. Lee, A. Johnson and J. F. Matthews as commissioners to mark boundaries

and provide court house and jail. The county seat chosen was Bishopville,
an incorporated town, which, originating before 1814 as Singleton's Cross » I

` Lee County comprises 410.5 square miles and has a population of 24,096
pcrsons,`whose chief occupation is agriculture. There is much tenant farms ·
ing. The sparsencss of settlement accounts in part for the small quantity ;

alteration, provided that all questions relating un their formation, names, ~
county seats, and boundaries, are first submitted to thc electorate in the
area affected. when one-third ef the qualified electors in any area peti- 5 "

and complying with the requirements of article 7, South Carolina Constitu— ;
tion of 1895, the governor order: an election to decide whether or not the ‘ ·
new county shall be formed, what siall be its name, and what its county seat. ww
If two-thirds·of the registered voters cast their ballots for the new county, ‘- `

The general assembly may provide for the consolidating of two or more F?
counties, for the organizing of other townships than those already estab- ,"
lished, and for changing their boundaries. It can group the various coun- if
ties.into judicial circuits and congressional districts, a d establish or {

The county board of commissioners is the administrative body which   -
acts in the name cf the county when it sues or is sued, or functions   de?
in its corporate capacity, The board is authorized to establish county   tw
e:;pe··ise, approve claims, borrow money when necessary, maintain roads and ASC}
bridges, provide towls, guards, food, clothing and shelter for county con-  
victs, care for the paupers, and report to the circuit court the conduct  
of the county business. The amount to be spent by the b
