The Board of Trustees of the University of Kentucky met in regular statutory session at 2:00 o'clock (EDT) on Friday, August 24, 1979 in the Board Room on the eighteenth floor of the Patterson Office Tower on the Lexington campus with the following members answering the call of the roll: Mr. William B. Sturgill, Chairman, Professor Michael Adelstein, Mr. William R. Black, Governor Albert Benjamin Chandler, Mrs. Betty Pace Clark, Mr. Albert G. Clay, Mr. Tracy Farmer, Mr. George W. Griffin, Mrs. Sally Hermansdorfer, Dr. David A. Hull, Mr. Thomas B. Kessinger, Mr. Zirl A. Palmer, Mr. Frank Ramsey, Mr. Homer W. Ramsey, Mr. Mark Metcalf, Professor Constance Wilson, and Dr. John R. Woodyard. Absent from the meeting were Mr. L. D. Gorman, and Mr. W. B. Terry. The University administration was represented by President Otis A. Singletary; Vice Presidents Lewis W. Cochran, Robert Zumwinkle, Peter P. Bosomworth, Raymond R. Hornback, John Smith, Jack Blanton, and Donald Clapp; Dr. Wimberly C. Royster, Dean of the Graduate School and Ccordinator of Research; Mr. John Darsie, Legal Counsel; and Dr. Charles Wethington representing Vice President Stanley Wall. Members of the various news media were also in attendance. A. Meeting Opened and Oath of Office Administered to Mr. Metcalf Mr. Sturgill, Chairman, called the meeting to order at 2:10 p.m. following the invocation, pronounced by Mr. Black, Mr. Darsie administered the oath of office to Mr. Mark Metcalf, who will serve as student trustee during his term of office as President of Student Government. The Secretary called the roll and reported 17 of the 19 members Dresent. The Chairman then declared the meeting officially open for the conduct of business at 2:14 p.m. B. Minutes Approved On motion duly made, seconded and carried, the reading of the Minutes of the June 28, 1979 meeting of the Executive Committee of the Board of Trustees was dispensed with and the Minutes were approved as published. C. Nominating Committee Appointed Mr. Sturgill named Mr. Homer Ramsey, Mr. Thomas Kessinger, and Dr. David Hull, with Mr. Ramsey as Chairman, as a nominating committee to prepare a slate of officers of the Board and members of the Executive Committee to be presented at the September 18 meeting of the Board. -2- D. President's Report to the Trustees (PR 1) Because of the length of the afternoon's agenda, President Singletary did not review the items in PR 1, copies of which were distributed to the members, and recommended that it be accepted and filed. Without objection, it was so ordered. E. Recommendations of the President (PR 2) After commenting that the items presented in PR 2 were routine in nature, President Singletary recommended that it be approved as a whole. On motion by Mr. Clay, seconded by Mr. Black, and passed without dissent, PR 2 was approved. (See PR 2 at the end of the Minutes) F. SupDlemental Recommendations of the President (Candidates for Degrees - University System) (PR 3a) President Singletary noted that there were two parts to PR 3 and recommended that PR 3a, which authorized the conferring of degrees on persons completing requirements in August, and one post-retirement appointment, be approved as a whole. On motion by Mr. Homer Ramsey, seconded by Governor Chandler and passed, PR 3a was approved. (See PR 3a at the end of the Minutes) G. Aopointment of Director, Multidisciplinary Center for Gerontology and Director, Sanders-Brown Research Center on Aging (PR 3b) At President Singletary's request, Dr. Bosomworth reviewed the background and fitness of Dr. William R. Markesbery for the dual role as the Director of the Multidisciplinary Center for Gerontology and Director of the Sanders-Brown Research Center. Both Dean Royster and President Singletary concurred in Dr. Bosomworth's assessment of Dr. Markesbery, and President Singletary recommended approval of his appointment. On motion by Mr. Clay, seconded by Professor Adelstein, and passed without dissent, William R. Markesbery, M.D., Professor, Department of Neurology and Pathology, College of Medicine, was named Director of the Multidisciplinary Center for Gerontology, University of Kentucky and Director of the Sanders-Brown Research Center on Aging, College of Medicine, effective September 1, 1979. (See PR 3b at the end of the Minutes) H. Report on Neo-Natal Expansion Project Because of the recent adverse publicity in the news media relative to the neo-natal program at the University, President Singletary requested Dr. Bosomworth to report on the progress being made in attaining the eventual goal of 45 beds in the neo- natal intensive care unit. -3- Dr. Bosomworth indicated that the management of neo-natal care in the University Hospital has been a four-phase program because construction must be carried out in existing patient care areas. Phases I and II have been completed and the unit currently has 31 beds (an increase from 17 to 23 and from 23 to 31). Phase III will increase the capacity from 31 to 39. The planning and architectural programming are completed and bids are ready to be awarded in Frankfort. The project should be completed in early May, 1980. Phase IV, which will add the remaining 6 beds, cannot be begun until renovation of the north wing is completed. Hopefully, this phase can be initiated in May or June of 1980. Relative to the transportation system, which has also received criticism, Dr. Bosomworth reported that the neo-natal transport service of the University Hospital began in February, 1979. The program was funded by the Department of Human Resources and it was the intention at that time to transport infants to Fayette County, either to the Medical Center or to Central Baptist Hospital. In the event that both of these facilities were at full capacity, infants were then transported to other hospitals in Louisville or Cincinnati. In April, 1979 the Director of the neo-natal care made the decision to curtail this service for infants not being transported to Fayette County. This deci- sion was made due to a reduction in staff and a growth of service beyond the original expectation, which resulted in a lack of capacity to handle all infants requiring transportation. The decision to curtail this facet of the transport system was made without the knowledge of Dr. Bosomworth. However, since learning of the change, he has indicated that the service will be resumed as expeditiously as possible. Renewal of the system will involve the addition of specialized nursing personnel who need to be both recruited and trained. The earliest possible date for resumption under optimal circumstances is a period of 90 days. I. Proposed Amendments to the Governing Regulations (PR 4) President Singletary recommended that the proposed amendments to the Governing Regulations as presented in PR 4 be received for consideration and placed on the agenda for action at the next meeting of the Board of Trustees. On motion by Governor Chandler, seconded by Mr. Black and passed, it was so ordered. (See PR 4 at the end of the Minutes) J. Joint Program in Food Science (PR 5) Because of the increasing demand for individuals with training in the area of food resources and nutrition, greater emphasis has been placed on this study in both the College of Agriculture and the College of Home Economics. To bring visibility to the area and increase scholarship and employment opportunities for the student, it is felt that it would be desirable to offer a joint program leading to the degrees of Bachelor of Science in Agriculture or Bachelor of Science in Home Economics with a major in Food Sciences. President Singletary recommended that the Board of Trustees authorize such a program for transmission to the Council on Higher Education. -4- On motion bv Professor Wilson, seconded by Mr. Kessinger and Dassed without dissent, authorization was given for submission to the Council on Higher Education of a joint program at the under- graduate level leading to the degree of Bachelor of Science in Agriculture or Bachelor of Science in Home Economics with a major in Food Science. (See PR 5 at the end of the Minutes) K. Capital Construction Projects (PR 6) President Singletary recommended that the Board approve for transmission to the Council on Higher Education the four capital construction projects as recommended in PR 6. The projects are as follows: (1) Seaton Center floor replacement; (2) Euclid Avenue flag plaza; (3) Structural repairs - Hopkinsville Community College Academic Building; and ('4) Parking lot paving - Jefferson Community College. On motion by Mrs. Hermansdorfer, seconded by Mr. Metcalf and passed without dissent, the four capital construction projects were approved for transmission to the Council on Higher Education. (See PR 6 at the end of the Minutes) L. Board Delegation for Handling Contract and Grant Awards (PR 7) President Singletary explained that it has been necessary to await Board of Trustees authorization for expenditure in the area of grants and contracts which has caused some delay in meeting obligations under the contract. He, therefore, requested that the Board delegate to him the authority to authorize expenditures from these accounts with such authorizations being reported to the Board at its next regular meeting following the authorization. Governor Chandler so moved, his motion was seconded by Mr. Black and passed without dissent. (See PR 7 at the end of the Minutes) M. Budget Revisions for 1979-80 (PR 8) President Singletary recommended that the revisions in the 1979-80 budget be authorized and approved. Without discussion, on motion by Mr. Palmer, seconded by Mr. Kessinger and passed, the proposed revisions in the 1979-80 budget were authorized and approved. (See PR 8 at the end of the Minutes) N. Biennial Budget Request for 1980-82 and Five-Year Plan 1979-84 (PR 9)7 President Singletary said that the biennial budget request presented for consideration was a part of the 1979-84 Five-Year Plan and provided total funding for the 1980-81 fiscal year of $313.3 million dollars, a 17% increase over the current year's budget and $341.5 million dollars for the 1981-82 fiscal year, a 9% increase over 1980-81. If approved, the state appropriations would amount to approximately $351.2 million dollars over the two year biennium. The remainder of the budget comes from tuition and fees, federal appropriations, gifts and grants and other such sources. -5- Through the use of charts, President Singletary summarized tha manner in which the proposed increases in state appropriations of $39.6 million dollars in the first year and $24.2 million dollars in the second year would be allocated. The major part (89% - 1980-81 and 86% - 1981-82) would be spent on continuing and improving present programs and salary catchup. Only 10% the first year and 12.8% the second year would be spent on program expansion, and new programs would amount to .8% and 1.2% respectively. Capital construction funding includes a new Architecture Building, Mining and Minerals Coal Center, expansion of the Seaton Center, a Primary Care Center, and Pharmacy Building, as well as additional facilities at the Community Colleges. After a brief discussion of the proposed budget, Mr. Homer Ramsey moved that the biennial budget request 1980-82 and the Five-Year Plan 1979-84, including the capital construction request, be approved for submission to the Council on Higher Education for review and recommendation to the Governor of the Commonwealth. His motion was seconded by Governor Chandler and passed with all present voting "aye". (See PR 9 at the end of the Minutes) 0. Lease to the Appalachian Regional Commission (FCR 1) Mr. Clay, Chairman of the Finance Committee, said that the Committee had met on the morning of August 24, and had only one recommendation to make to the Board. He then moved that the Vice President for Business Affairs and Treasurer be authorized to negotiate and execute an 11 year lease of a .79 acre site on Coldstream Farm to the Appalachian Regional Commission. His motion was seconded by Mr. Palmer and passed without dissent. (See FCR 1 at the end of the Minutes) P. Report of Investments (ICR 1) Mr. Griffin, Chairman, reported that the Investment Committee had met on the morning of August 24, and approved the report of changes made in investments. He then moved that the report of the changes made in investments for the University of Kentucky and its Affiliated Corporations for the quarter ended June 30, 1979 be accepted. His motion was seconded by Mr. Kessinger and passed with all present voting "aye". (See ICR 1 at the end of the Minutes) P. Meeting Adjourned Mr. Sturgill reminded the members of the Board that the next meeting would be held on September 18. Assignment of Letters of Patent - DeLuca and Butler Recommendation: that the Board of Trustees, by and through its chairman, William B. Sturgill, execute the assignment of rights for the Letters of Patent of Patrick DeLuca and L. David Butler titled "Testing the Integrity of Liquid Containing Hermetically Sealed Containers by the Use of Radioactive Markers" to the University of Kentucky Research Foundation. Background: Dr. DeLuca and Dr. Butler have assigned their rights to the invention mentioned above to the University of Kentucky. In accord with usual practice, it is recommended that the Uni- versity assign the patent to the University of Kentucky Research Foundation. II. Assignment of Letters of Patent - Triplett and Smith Recommendation: that the Board of Trustees, by and through its chairman, William B. Sturgill, execute the assignment of rights for the Letters of Patent of John W. Triplett and Randall B. Smith entitled "Synthesis and Use of Diagnostic Radio-Pharma- ceuticals Comprising Radioactive Isotopes of Bromine with Dyes" to the University of Kentucky Research Foundation. Background: Professors Triplett and Smith have assigned their rights to the invention mentioned above to the University. In accord with usual practice, it is recommended that the University assign the patent to the University of Kentucky Research Foundation. III. Appointments and/or Other Staff Changes Recommendations: (1) that approval be given to the appointments and/or other staff changes which require Board action; and (2) that the report relative to appointments and/or changes already approved by the administration be accepted. Background: The following recommended appointments and/or other staff changes require approval by the Board of Trustees in accordance with Part VIII-B of the Governing Regulations of the University.
