Collection Overview

Biography / History
Edward Huggins Johnstone served as a judge for the United States Western District of Kentucky from 1977 to 2013. Johnstone was born on April 26, 1922 in Sao Paulo, Brazil and grew up in Paducah, Kentucky. He served in World War II as a U.S. Army Sergeant in the 9th Infantry Division. Following the war, he attended the University of Kentucky College of Law and received his juris doctorate in 1949. Johnstone then settled in Princeton, Kentucky, where he practiced law until 1976. During these years, he was named city attorney for Princeton and the neighboring towns of Kuttawa and Fredonia (1952-1976); judge on the Princeton Kentucky Police Court (1954-1969); and judge on the Fifty-Sixth Judicial Court (1976-1977). President Jimmy Carter nominated Johnstone on August 25, 1977 to serve as a judge for the U.S. Western District Court of Kentucky, to a seat vacated by Judge James F. Gordon. The Senate confirmed his nomination on October 7, 1977.
On the district court bench, Judge Johnstone served as chief judge from 1985 to 1990 and as a member of the Judicial Conference of the United States from 1991 to 1993. He assumed senior status on October 22, 1993 and continued to serve in that capacity until his passing on June 26, 2013.
Johnstone is most known for his decisions in Kendrick v. Bland (1981), Thompson v. Bland and Canterino v. Wilson (1982), a trio of cases that improved living conditions and educational opportunities for people imprisoned at the Kentucky State Penitentiary, Kentucky State Reformatory, and the Kentucky Correctional Institute for Women. Judge Johnstone also presided over In re Air Crash Disaster at Gander, Newfoundland on December 12, 1985 (1987), multidistrict litigation in which plaintiffs sued Arrow Air Corporation for the deaths of 248 U.S. Army personnel and eight crew members aboard Arrow Air Flight 950, which crashed in Gander, Newfoundland en route to Fort Campbell, Kentucky. Other notable cases include: U.S. v. Oliver (1980), regarding Fourth Amendment limitations on law enforcement; U.S. v. Barger (1988), involving Ralph Hubert Barger, the leader of the Hell's Angels Motorcycle Club; and U.S. v. Ignatow (1992), about perjury charges related to the murder of Louisville resident, Brenda Sue Schaefer.

Scope and Contents

This series documents the civil, criminal, administrative, and multidistrict litigation over which Judge Johnstone presided during his tenure as a trial court judge on the Western District Court of Kentucky. It comprises the largest portion of this collection. The papers primarily relate to cases that originated in the Western District Court; some materials, however, pertain to cases in other federal districts that Judge Johnstone presided over as a visiting judge.

Files consist of draft and published opinions and orders, slip opinions, law clerk memos, jury instructions, transcripts of court proceedings, news clippings, notes, correspondence, research files, photographs, and a variety of court filings including complaints and docket sheets. Also included are medical and other health records, sentencing and parole reports, law enforcement transcripts and reports, and other materials that may contain personally identifying information or other privacy-related information.

Of particular note are case files related to Kendrick v. Bland (1981) and Canterino v. Wilson (1982), which set standards for living conditions and educational opportunities for people imprisoned at the Kentucky State Penitentiary, Kentucky State Reformatory, and the Kentucky Correctional Institute for Women. Scope and Contents

This series primarily consists of reference and working files documenting Johnstone's judicial activities. Files relate to Johnstone's caseload statistics, the Judicial Conference of the United Status, his 1977 confirmation to the Western District Court of Kentucky, visiting judge assignments, naturalization ceremonies, his portrait unveiling, and various other markers of his judicial life. Files consist of orders and other court filings, memos, correspondence, reports, news clippings, event programs, photographs, greeting cards, and nametags from judicial events. Materials contain personally identifying information or other privacy-related information.

In addition, this series contains materials related to the Johnstone family, including family photographs, correspondence with relatives, and photographs and news clippings documenting Johnstone's father, W. C. Johnstone.
